Allahabad HC Questions UP Government NOC Requirement for BPharm Courses

Allahabad High Court BPharm NOC: The Lucknow bench of the Allahabad High Court has questioned the requirement for educational institutions to obtain a No-Objection Certificate (NOC) from the Uttar Pradesh government before starting Bachelor of Pharmacy (BPharm) courses. The court has sought a detailed response from the Pharmacy Council of India (PCI) on the issue.
A bench of Justices Rajan Roy and Manjive Shukla raised the questions while hearing a batch of petitions involving the PCI, Uttar Pradesh government and educational institutions. The PCI has been directed to file an affidavit, if required, within two weeks.
Allahabad HC Questions BPharm NOC Requirement
The court observed that under the Bachelor of Pharmacy Course Regulations, 2014, institutions seeking approval are required to have prescribed infrastructure, including buildings, laboratories, equipment and teaching and non-teaching staff. However, the bench questioned why there is no clear format or defined criteria for issuing an NOC by the state government.
The court also questioned why an NOC is required for BPharm courses when there is no similar arrangement for Diploma in Pharmacy (DPharm) courses.
The PCI has been asked to clarify the meaning and scope of the scheme referred to under Regulation 9. The Uttar Pradesh government has also been directed to submit examples of NOCs issued previously.
Court Questions NOC and Affiliation Distinction
The Allahabad HC further questioned the distinction between an NOC issued by the state government and consent for affiliation. The bench observed that affiliation is a matter concerning the university or competent affiliating authority and may be considered after PCI approval.
The court will also examine whether the state government has jurisdiction to declare a zero session or impose a moratorium on BPharm and DPharm institutions or courses. The matter has been listed for further hearing after two weeks.
