Delhi High Court Rejects PIL Against CBSE’s Class 12 On-Screen Marking System

Delhi High Court has rejected the PIL filed against the CBSE’s on screen marking system for Class 12 exams. The PIL was filed for alleged technical glitches and evaluation irregularities in Central Board of Secondary Education,CBSE’s, on screen marking system used for Class 12 board exams. The court said that the issue has already been highlighted in the Supreme Court of India and has refused to intervene in the PIL.
Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia made is clear that the Delhi HC will not be evaluating the PIL and that individual student grievances for evaluation or revaluation of an answer key is a personal cause of action. The court also said that any student who thinks that their result showed error can reach out to CBSE or Delhi court according to the procedure.
NSUI’s Plea Against CBSE and Similar Plea in Supreme Court
The National Students’ Union of India President, Vinod Jhakar, filed a PIL against the CBSE’s marking system saying that there were many discrepancies in the OSM system. He alleged that many students, parents and teachers reported serious problems with the scanned answer sheets as these included blurred copies, missing pages and incomplete uploads. It also showed unexpectedly low marks after the CBSE Class 12 results declaration.
NSUI has asked for compensatory marks for students who were affected by these discrepancies. The organization also asked for revaluation of marksheets and physical verification of answer sheets.
Tushar Mehta, CBSE’s Solicitor General, referred to a similar plea filed in the Supreme Court of India which was rejected after the ruling and argued that re-evaluation process is complete and there has not been any error in the checking of answers. He also said that the academic session has already begun and counselling for many courses was already at an advanced stage.
