UK Orders Google to Reveal Search Ranking Criteria, New Rules Seek Transparency and Fair Competition

The UK government is increasing its regulation of Google's search operations. Recent proposals will require the company to disclose more information on how it ranks search results to create a more level playing field among digital competitors and give businesses the tools they need to understand how their presence in search results is determined. 

The regulators believe that Google's position as the leading provider of online search confers substantial control to the company over the flow of information and the flow of consumers to businesses. The proposed regulations are part of a larger initiative to ensure that large technology companies operate in a manner that benefits both consumers and businesses.

Why Does the UK Want Search Transparency?

The UK Competition and Markets Authority has identified a problem for companies dependent on search traffic to generate business, their lack of clarity regarding the processes by which search ranks are established has created significant uncertainty and could hinder their abilities to compete successfully in digital commerce.

In the CMA's opinion, providing more transparency around how web pages are ranked could foster business engagement with and reliance on search engines while simultaneously improving trust between users and search engines. Such a move would also address the worry some companies have regarding the market power that large companies can exert over their markets through the use of possibly unknown algorithms to determine ranking criteria.

What the Proposed Rules Mean for Google?

According to this new framework, it will be mandatory for Google to disclose additional factors affecting its ranking system and how they impact which sites appear most often in results.

In addition to providing greater transparency regarding what factors go into determining search rankings, these measures, if implemented, will increase the fairness of the way that businesses are treated on the platform when trying to reach customers.

The Australian Competition and Consumer Commission (ACCC) does not plan on forcing Google to make its algorithms public, but rather to provide sufficient information about what types of factors affect searches to help businesses understand the ranking process.

Google's Response to Regulatory Scrutiny 

According to Google's position, users should expect to find the best available result of any search term. Google claims to continuously update their rankings to improve search quality, avert spam, and respond to shifts in user behavior.

Excessive disclosure of the ranking process could lead to more opportunities for people to manipulate the ranking process, which would reduce overall quality of results returned.

Concerns Over Google's Market Dominance 

With Google continuing to dominate as the world's primary source of Internet searches, Google is at the forefront of accessing information, products, and services. As a result, there has been increasing scrutiny of the power held by such companies. Many regulators have raised concerns that the dominant marketplace position of Google may provide a significant barrier to entry for existing and future competitors, restricting choice for consumers.

The most recent proposed regulations around the world are part of a larger trend of governments looking at the abilities and the impact the largest technology firms have on society and their future ability to protect competitive digital marketplaces.
